Couples who are going through a divorce are faced with many life changing decisions. There is normally a high level a stress involved in divorce and it is not uncommon for communication to be strained. Reaching an agreement on who will sell the home, how much to sell the home for and what improvements should be made to market the home must be handled very delicately.

 

The home is normally the largest asset and both parties may be relying on their portion of the equity to help them after the divorce. For this reason it is very important that the home sells for as much as possible.

 

Couples in a divorce normally need the home to sell very quickly to prevent conflict over who will make the house payment during and after the divorce. Finding the balance of selling the home at the highest price AND in the shortest time period requires the expertise of an experienced negotiator and Realtor.

 

Sometimes couples are not able to work together in selling the home and the Realtor must act as a “mediator” between the couple. One of the biggest sources of conflict divorcing couples have is how the home will be sold. Often time’s one party wants to use one real estate agent and the other party wants to use somebody else. The parties don’t trust each other and feel that each others agent will take sides. Having a neutral agent that is accountable to both parties is very important.

What to do next?

You will first need to determine if you are going to mediate or litigate your divorce. You should not even talk to an attorney until you attempt mediation. Couples that mediate are the couples that get all of their divorce costs paid. If you end up litigating, your divorce costs will be much higher, and may make it less possible for us to pay your divorce costs. Bottom line, you need to try mediation.
