1. Can I choose my own attorney or mediator?
Yes. As long as your mediator or attorney participate in the network. If your attorney or mediator is not in the UFD network then we can ask them if they would like to be a part of the network so you can get a discount. Most of the time they will participate as it costs them nothing and they will want to try and save you as much money as possible.
2. What if I am already in the middle of litigation or mediation and have already paid my attorney or mediator?
We will talk to your mediator or attorney and figure out an amount that you can be discounted. A credit for your fees may then be issued
3. What if one party wants to sell or refinance the home and the other party does not?
The husband and wife must be in agreement on what they are going to do with the home. If they are not sure what they want to do but feel they will agree then a good mediator can explain the options and pro and cons of selling, keeping, or refinancing and help the divorcing couple choose which option is best for them.
4. Why do some people qualify for 100% of their divorce costs to be waived and others don’t?
Due to variables to include the value of the home, the amount owed on the home, the credit and borrowing strength of the individuals, some cases may not provide sufficient commissions or fees for the realtors or loan officers. This is rare and even in the worst cases a discount will be offered if you use their services.
5. How do the attorneys or mediators get paid for their services?
The mediator or attorney will submit an invoice to the real estate agent or mortgage broker and they get paid directly. To prevent any conflict of interest the mediator or attorney must charge their standard rate.
6. Do the real estate service providers offer any discounts to their services?
Yes! This will be determined on a case by case basis but if there are going to be multiple transactions for example a if the couple is going to sell the home and then needs to buy 1 or 2 homes and also needs financing for those homes then you could expect a significant discount on all of the transactions. Bottom line is that commissions are flexible.
